UPDATE ON THE SUIT , NWABUEZE OKAFOR vs VICTOR OYE & ORS.
Yesterday at the FCT High Court 4, Abuja , the court granted an application by lead counsel to the national chairman of APGA , Ozonkpu Dr. Victor Oye, Chief Wole Olanipekun SAN, praying the court to refrain from entertaining the suit pending the hearing and determination of the interlocutory appeal against the spurious decision of the said judge, granting an order for the amendment of the plaintiffs writ of summons without first determining an application challenging the courts jurisdiction to entertain the suit.
When the case came up for hearing on Nov. 30, 2016 the judge preposterously granted the prayer of the counsel to the plaintiffs (JS Okutekpa) to make amendments to the writs they filed on October 7, 2016, when the jurisdiction of the court to hear the suit was being called to question.
The action of the judge, was ostensibly spurious and suspicious. Consequently, our counsels appealed against the granting of the motion for amendment without first dealing with the issue of jurisdiction.
The Notice of Appeal at the Court of Appeal, Abuja, was served on the plaintiff's counsel on Thursday, while the application for stay of proceedings from the Court of Appeal was served on the judge of FCT Court 4 on Friday morning.
Hence, our legal team comprising Chief Wole Olanipekun (SAN), Onyechi Ikpeazu (SAN), Okey Mozia (SAN), and 10 others prayed the presiding judge that since the matter had been transmitted to the Court of Appeal he (the judge) did not have any jurisdiction to still entertain the case pending the determination of the case at the Court of Appeal.
After a brief legal argument the judge agreed with the submission of our lead counsel, Wole Olanipekun, and stayed the matter.
The court proceedings were witnessed by the National Chairman of APGA, Ozonkpu Dr. Victor Ike Oye, the two deputy national chairmen, 6 National Vice Chairmen, some members of the National Working Committee (NWC), numerous party supporters from across the country.
At the close of court proceedings the National Chairman , Ozonkpu Dr. Victor Oye led NWC members present , and Party faithfuls back to the National Secretariat for prayers.
